Matters Raised in the Public Forum

The grass verge on the perimeter of the new build called “Village End Barn” looks very unsightly with overgrown thistles and weeds.  The Councillors agreed and noted the comment made.

The council meeting commenced at 7.05 pm.

46/21   TO RECEIVE AND RESOLVE TO ACCEPT APOLOGIES OF ABSENCE:

Apologies received from Cllr. P Fotheringham and Cllr. J Milne. 

47/21     MINUTES OF MEETING – 20th July   2021:

It was proposed by Cllr P Rushton and seconded by Cllr Barrow that the official minutes of meeting held on         the 20th July 2021 are approved as correct records and signed by the Chairman. Resolved.

48/21     TO RECEIVE DECLARATIONS OF INTEREST UNDER THE LOCALISM ACT 2011:

There were no declarations of interest.

49/21     TRAVELLER SITE UPDATE:

A teleporter was brought to the site and clearance of the rubbish was started. The rubbish was removed             by 2 artic trailers and the site appears to be clear.  It is unknown at this stage who actually cleared the waste. Resolved.

50/21     OVERGROWN HEDGE CHURCH ROAD EAST:

The Clerk informed the Council that a letter had been sent to the landowner requesting that he cut it back.

No response has been received.  Clerk was asked to report it to Highways. Action required.

51/21     RESIGNATION OF CLLR A FOTHERINGHAM:

The clerk had received a letter of resignation from Anne Fotheringham, which had been previously circulated to all Councillors. Clerk to send a letter of acceptance and to thank her for her time with the council. Action required.               

52/21     APPLICATION FOR COUNCILLOR:

The Clerk had received an application from Kevin Smith.  Cllr S Barrow proposed the application and          Cllr P Rushton seconded the motion to accept Mr Smith to join the council.  All in agreement.  Clerk to provide Mr Smith with all the relevant paperwork so he can be co-opted onto the council.

53/21     FIBRE BROADBAND UPDATE:

No further information has been received from Quickline regarding any progress to supplying Fibre                        Broadband to Upton.

54/21     FOOTPATH 52:

An email had been received from Chris Marsh of LCC on the outcome of our enquiry regarding repairs to this                 footpath.   Content of the email below.

Yes, I looked Friday afternoon as I were drawing on feint recollection which proved wrong, it's flagged throughout. Liability would only be conceded if the trips presented by the flags met or exceeded 'intervention level' of 25mm. Without taking detailed measurements I'm confident that isn't the case. I'm not sure what the maximum crossfall is, but Highways have certainly introduced a steeper crossfall new (I think of their treatment of the Viking Way up Canwick Hill which I was assured was fully compliant in raising my concerns at the time.

It could be reconstructed in tarmac, but we've only a mandate to that narrow section to the point where it's been built over. That wouldn't make it a particularly attractive scheme as it would be perceived we'd done only half the job. Anyway, noted for consideration in selecting next round of any projects.

If LCC deny liability then it's for a plaintiff to either press ahead with action against LCC to whatever outcome, or to think again and identify another party or cease litigation.

There's no proven rights or maintenance mandate on the next section of path Avenue A to Church Road. If any rights were dedicated post 1960 then the route wouldn't be publicly maintainable anyway by virtue of Highways Act 1959.

55/21     QUEENS JUBILLE CELEBRATIONS:

The Clerk had ordered a sample celebration mug to commemorate the Jubilee and this was presented to the  Councillors for their thoughts. It was agreed that it would be fitting to present a mug to all children in  Upton under the age of 16.  It was also agreed that a flyer should be sent to every household asking them to fill in and return a slip to the Clerk by a given, with the names and ages of the children in that household.        Clerk to do a poster, size to be confirmed. Action required.

56/21     FINANCIAL ISSUES:

The Clerks salary was proposed for approval by Cllr. M McDaniel and seconded by Cllr. P Rushton. Resolved.

All payments and receipts were approved. Proposed by Cllr. M McDaniel and seconded by Cllr. S Barrow.    Resolved.

57/21     PLANNING APPLICATIONS FOR CONSIDERATION:

143497. Extension Lodge Lane. No objections.

58/21     PLANNING APPLICATION DECISIONS:

143151. 7 High St. Garage and workshop. Granted.

 

59/21     CRIME REPORT:

June/July. Offender(s) forced rear door of work van and took a number of tools.
